Separation

When a cohabitation relationship ends there is no legal duty on either party to pay maintenance to support the other. This is the case no matter how long the relationship has lasted and no matter how great the difference in the income of the parties. As Solicitors, we can advise you on the end of the relationship and what if anything you or your Partner can claim.


The House

This is often the most valuable asset. When parties are not married, what happens to the house at the end of a relationship depends on the circumstances of each individual case and some very complicated legal provisions.

Another misconception is that by living together, a person automatically acquires an interest in the property no matter how long the relationship has lasted. This again is not true.

Any interest will depend on whose name(s) are recorded on the Title Deeds and if this is not clear then the complicated Law of Trusts works out who is entitled to what, if anything out of the house.

Child Maintenance

On a relationship breakdown, the “parent with care of  a child or children”  is entitled to ask the other parent for financial support for their child (ren) whether the parties are married or not.

This can be by way of a Maintenance agreement (that we can draw up on your behalf) or though an application to the CSA. Again, we can advise you on the best way to proceed in your case.

 

A New Will

We also advise all clients that are getting divorced to make a new Will. Your Will is an important legal document. It is also only ‘tested’ when you are no longer around, so it is essential that your Will is prepared correctly. If you fail to have a Will drafted correctly or have no Will at all, then you could leave your family/friends to deal with complicated and expensive legal issues.

We offer an exclusive rate to on-line clients who can have a Last Will and Testament prepared on their behalf for just £65 or £100 for mirrored Wills (normally £150). And as we are a firm of Solicitors, you can be confident that your Will has been prepared correctly and is legally enforceable.

Children Matters

We are able to assist with any children issues that may arise as a result of your divorce or separation. As we are a firm of Solicitors, we are able to act on your behalf in any proceedings to determine where your child/children should live (residence) or how much contact your children should have with your former spouse.

We offer all online divorce clients a 10% reduction from our normal fees and are also happy to offer an initial free consultation.
